Sword Man Escapes Jail
Friday, 23rd September 2005.
A man who threatened to cut off a policeman's head with a Samurai sword has escaped a jail sentence.
Terry Hayes, 30, received a suspended sentence after pleading guilty to affray and having an offensive weapon.
The court heard the incident ended with a police officer firing a rubber bullet, causing injuries which put Hayes in hospital for nine days.
Hayes, of Beaconsfield Court, Haverhill, appeared at Ipswich Crown Court before Recorder Neil Garnham QC last week, who jailed him for 50 weeks, suspended for two years. Hayes must pay £392 prosecution costs.
Marc Cannatella, prosecuting, told how the incident occurred at around midnight on August 7th after a family row. Police were called and Hayes was seen holding a Samurai swork on a balcony. Hayes told a policeman he would cut his head off.
Defence barrister Lyndsay Cox said Hayes could remember nothing of the incident.
