Man cleared of assaulting DJ in nightclub

Thursday, 12th October 2000.

A CLUBBER has been cleared of assaulting a DJ after his wife said she had done it.
Alan Moule, 32, of Clover Fields in Haverhill, was alleged to have smashed a bottle over the head of DJ Julian Cunnington at the town's Rush nightclub on January 15.
But a jury at Ipswich Crown Court found the independent financial adviser not guilty after his wife Dawn said she had attacked Mr Cunnington.
During the trial, which lasted a day and a half, Mrs Moule said she had become "a bit irate" over a bottle of champagne up for grabs as a prize in the nightclub.
She thought the prize was for dancing but discovered she was expected to kiss lighting man David Bastian.
When the club was closing at around 2am she went up to "slap" Mr Cunnington, she said.
She added that she had a bottle in her hand at the time.
Mr Cunnington told the court she had attacked him, scratching him and ripping his T-shirt.
He said he was hit over the head with something which made him dizzy and caused blood to pour from his head. He did not see who did it.
Mr Moule denied attacking the DJ and said he was trying to separate his wife from him, although he accepted he had a bottle with him too.
He said: "I had cuts on the back of my left hand. I can only assume now that it was Dawn's bottle which had broken."
After the case he said: "Justice has been seen to be done. My faith in the system was diminished over the way the police investigated it but it has been restored as a result of the jury's verdict."
